Age Restriction Bylaw Exemptions

As we are aware, in November 2022 the Government of BC amended the Strata Property Act to end all rental-restrictions and age-restrictions (19+) bylaws in strata corporations. Although most age restriction bylaws were no longer enforceable, stratas were still permitted to enforce existing and pass new bylaws with a 55 and older age restriction.

A few hundred strata corporations in BC quickly moved to adopt 55+ age-restriction bylaws. Inmost cases, these properties already had an age restriction (ie. 45+) and they were increasing the age to comply with the new Act amendments.

On May 1, 2023,the Strata Property Regulations were amended to allow exemptions in 55+ strata corporations. The exemptions include children (including adult children),and younger spouses or partners. It will also create an exemption to permit adult children or former dependents of current residents to move back home with their parents or former caregivers.

 This change will ensure that people living in stratas with 55+ age restrictions will be able to stay in their homes even if their family structure changes.

This will only impact a handful of Wynford clients. Our records team and strata agents are informed and will ask for the correct documentation as it relates to 55+ strata corporations under our management.
